1. Definitions In these terms of use
The following terms have the following meanings:
Limburg Marketing
A working group within the Hart van Limburg Foundation; licensee of the VVV trademark and part of VVV Nederland BV, registered with the Dutch Chamber of Commerce under number 12067980.
App
The Erfgoed Route App, which can be downloaded via the App Store and Google Play.
Visitor
Anyone who visits the locations of the Erfgoed Route Limburg via the Erfgoed Route Limburg app.
2. Applicability
These terms of use apply to every visit to the locations listed in the Erfgoed Route App. The terms are freely accessible and available on the website ErfgoedRouteLimburg.nl. The Erfgoed Route Limburg app refers to these terms. By using the Erfgoed Route app, every visitor to an Erfgoed Route location is deemed to have tacitly accepted these terms. Limburg Marketing may modify or update these terms of use at any time without prior notice.
If one or more provisions of these terms of use are or become wholly or partially inconsistent with any legal requirement, or are null and void or annulled, the remaining provisions will remain in full force and effect. The parties will then agree on a provision that most closely reflects the intention and effect of the invalid or annulled provision(s).
3. Liability when visiting Points of Interest
Limburg Marketing takes the utmost care to ensure safety at the Points of Interest along the Erfgoed Route Limburg. Our goal is to offer visitors a safe experience of the story on location. However, the Points of Interest are located in public spaces. Limburg Marketing cannot be held responsible for any accidents occurring at these locations. Before using the app at a location, please check your surroundings for safety. Watching or listening to a story in the app may cause distraction. Be careful not to injure yourself when approaching the Point of Interest. Limburg Marketing accepts no responsibility for any such injuries.
4. Liability regarding app content
Limburg Marketing also takes the utmost care regarding the information provided in the app. Nevertheless, inaccuracies or omissions may occur. Limburg Marketing is not liable for any damage resulting from inaccuracies or omissions in the information provided, nor for damage resulting from issues inherent to the distribution of information via the internet, such as interruptions, disruptions, errors, or delays in the provision of information or services via the website or other digital means. Limburg Marketing also accepts no liability for damage resulting from the use of data, advice, or ideas provided through or on behalf of Limburg Marketing via the app. Limburg Marketing takes no responsibility for the content of websites referred to by hyperlinks or other means.
5. Equipment
Limburg Marketing accepts no liability for any damage to the visitor’s equipment resulting from the use or access to the app. Visitors are responsible for obtaining appropriate software, hardware, and internet connections necessary for the use of the app.
6. Intellectual Property Statement
The information, text, images, photos, and illustrations on this app, and the design of the website ("the Content"), in which significant investment has been made, are protected under the Copyright Act, the Database Act, and other applicable laws. Except as legally permitted, this content may not be reproduced, embedded, shared, or published without prior permission from Limburg Marketing. Retrieving and viewing the content and printing it for individual personal use is permitted within the boundaries set by applicable legislation.
The word and logo marks on this app are the property of Limburg Marketing. It is not permitted to place any of these marks or logos on your own site or use them otherwise without prior permission from Limburg Marketing.
7. App Privacy – App Permissions
These permissions may be requested because they are necessary for specific features in the app:
Camera: to scan QR codes. The camera feed does not leave your device and is not stored or shared. Only QR code matches are processed; decoded content is not displayed.
Location services: to determine whether you are within GPS range of a Point of Interest. Your location is not stored or shared.
Local notifications: to notify you when you are within GPS range of a Point of Interest. Notifications only appear when a GPS route is active in the app.
External media: The app can load text, images, audio, and video from our content server via the internet. This ensures the content remains up-to-date. Media cannot be loaded from other external sources.
8. Data Collection and Use
The app does not include functionality to:
- Create, log into, or link user accounts
- Enter text other than numbers 0–9
- Make purchases or participate in gambling
- Display third-party ads
- Access unrelated files on your device
The only information that may be collected is your location while using Google Maps within the app. This third-party service may collect anonymous location data. See their privacy policy for more details.
9. Google Play Services
Local storage: The app stores user progress locally. This data is used to show viewed content and can be cleared via the in-app settings or by uninstalling the app.
Log data: We do not collect log data ourselves through the app. However, the App Store and Play Store may collect anonymous log data for performance and crash analysis. This may include device information, operating system, app configuration, usage time, and other statistics.
Children’s Privacy: This app is not intended for independent use by children under the age of 13. We do not knowingly collect personal data from children under 13. If you believe your child has provided us with personal data, please contact us so we can delete it.
10. Governing Law and Jurisdiction
These terms of use are governed by Dutch law. Disputes arising from these terms will be submitted exclusively to the competent court in Roermond.
11. Changes to this Privacy Policy
We may update this privacy policy from time to time. We recommend checking this page regularly. Updates will be published here.
